By purchasing, redeeming, and/or using this Island Funpass booklet, card, voucher, mobile or printed ticket or e-ticket issued by IslandFunpass.com (the “TICKET”), you, on behalf of yourself, any accompanying minor or other person who You are responsible for, and Your heirs and assigns (collectively referred to as “You”) agree to the following terms and conditions with IslandFunpass.com, its officers, employees, successors and assigns (referred to as “Us”, “We” or “Our”):
Each TICKET is valid for one-time admission to the attractions included on Your TICKET at the time of purchase (an “Attraction”) unless otherwise noted on the TICKET. Each TICKET must be used prior to the expiration date of such TICKET. Each TICKET is valid for 2 or more consecutive days, including the day of first use. Each TICKET is non-transferable and the amount of consecutive days of use shall be specified on each TICKET and the purchase receipt. ID may be required for entry to an Attraction. Island Fun Pass, it’s owners, partners and tour operators are not responsible for lost or stolen TICKETS.
You are subject to each Attraction’s rules, regulations, terms and conditions as a condition of entry to each Attraction. Attractions may change operating hours, close temporarily, or may otherwise change or be discontinued without notice and without liability to Us or the Attractions.
Persons over the child age range must purchase an adult TICKET. Attractions may deny entry to anyone over the child age range who presents a child TICKET. The use of a single TICKET to gain admissions by multiple individuals, or other misuse of a TICKET, is a criminal offense. You accept responsibility for each TICKET that You purchase and consent to Your credit card being charged to remedy any misuse. Any misuse may result in the TICKET being confiscated and/or voided without refund. Your entry to an Attraction constitutes consent for each Attraction and Us to use any film, photograph, video, or likeness of TICKET bearer for any purpose whatsoever without any payment or other compensation to the TICKET bearer. The TICKET cannot be combined with other discounts. Partially or fully used TICKETS are non-refundable. Refunds are offered if the TICKET has not been used at any Attraction within the specified days of purchase per our Return Policy.
You voluntarily assume all risks and danger of personal injury, property loss and all other hazards arising from, related to or incidental to Your visit to each Attraction, whether before, during or after Your visit.
We are a tourism marketing company and have no responsibility or control over the operation of any Attraction included in the TICKET. By purchasing the TICKET, You have agreed that Our liability for any claim, injury, loss, theft, tort, or other dispute or controversy (“Claim”) that is directly or indirectly related to Your visit to an Attraction, any travel to or from an Attraction, or Your TICKET purchase experience with a third party TICKET seller, is limited to a refund of the TICKET, regardless of the type of Claim.
By purchasing the TICKET, you agree that any Claim by you or us against the other, arising from or directly or indirectly relating to the TICKET shall be resolved exclusively and finally by binding arbitration under the rules and procedures of the Philippine Institute of Arbitrators (PIARB). The arbitrator may award money or injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party’s individual Claim. You agree that Claims made and remedies sought as part of a class action, or other representative action are specifically excluded and prohibited, and instead are subject to arbitration on an individual basis. The laws and courts of Muntinlupa City, Philippines shall govern these terms and conditions of Your purchase, redemption and/or use of this TICKET, without giving effect to conflicts of law provisions.
By purchasing this TICKET, you agree to waive, and have waived, all rights to pursue or participate in a class or collective action, or other action or claim in a representative capacity, arising from or relating in any way to the TICKET, either in any court or in arbitration.
